Driving is a privilege that is granted by the Illinois Secretary of State.  As such, the Illinois Secretary of State retains the authority and discretion to suspend or revoke an individual's driving privileges.  When an individual's driving privileges have been suspended or revoked, the individual must apply to the Illinois Secretary of State for reinstatement of those driving privileges.

Driving privileges may be reinstated after an informal hearing or a formal hearing with the Illinois Secretary of State.  The reason or basis for suspension/revocation will determine whether an informal or formal hearing is required.  Representation by an attorney at informal or formal hearing is not required but may be recommended, as being properly prepared for a hearing before the Illinois Secretary of State may make the difference between obtaining a reinstatement of driving privileges and being denied driving relief.
